The Federal Court of Criminal Cassation under the presidency of the judge Mariano H. Borinsky carried out an activity for the 30 years of the Belém do Pará Convention.
The Court’s Gender and Justice Commission, coordinated by Angela E. Ledesma and made up of Daniel A. Petrone, Diego G. Barroetaveña and Mariano H. Borinsky, organized the activity that was carried out in person in the Auditorimum Room. The venue was filled with magistrates, officials and employees of the Nation’s Judicial Branch and virtually through the ZOOM platform.
Angela Ledesma He began the event by referring to the reason why this important date is commemorated and highlighting the importance of building spaces for reflection on the topic. Judge Ledesma highlighted the impact of the Convention on judicial decisions and made special reference to various rulings of the Supreme Court of Justice of the Nation. In addition, she stressed the importance of the speakers who made up the panel and called for compliance with the course provided for in the Micaela Law organized by the Women’s Office of the Supreme Court.
Then it was time for the presentations of the panel, made up of the Director of the Gender Observatory in Justice of the Judicial Council of the Autonomous City of Buenos Aires, Diana Maffia; the Official Public Defender, Julieta Di Corleto and the member of the training area of the Women’s Office of the Supreme Court of Justice of the Nation, Gabriel Charrúa.
The speakers analyzed the historical origin of the Belém do Pará Convention in our country, the challenges of its constitutional hierarchy in the domestic sphere, the paradigms of practical application required by the Convention and the diverse approaches that the Supreme Court has adopted in matters of violence against women. For his part, the person in charge of the training area of the Women’s Office of the Supreme Court of Justice of the Nation referred to the importance of this training space, giving an account of the different courses available on gender perspective and announced the upcoming opening of the course on legal argumentation and gender.
Later, the musician Leandro Airala performed the song “No es No” of his own, through which women who can raise their voices against violence are honored.
Finally, Mariano Borinskand, he closed the meeting, highlighting the importance of judicially addressing gender violence in all its types: (physical, psychological, sexual, economic, symbolic) and in all its areas, including violence in situations of detention. Then, he referred to the importance of training on the subject and mentioned that both he and other judges of this Chamber have already completed the course of Law 27499 “Micaela Law” mandatory for all State agents. Likewise, he highlighted the various actions that have been adopted on gender matters by the Presidency, highlighting the dissemination of jurisprudence through specialized bulletins and the organization of work well-being days.
The “Gender and Justice” Commission of the Federal Chamber of Criminal Cassation works for parity between women and men, as well as non-discrimination against women in the enjoyment and exercise of human rights and fundamental freedoms. .
