The president of the court James Allsop opened the session in which this saga must be decided and the participation in the Australian Open of the number one in men’s tennis from Monday.
Secluded since Saturday in a refugee hotel, where he already spent five days when he arrived in Australia on January 5, Djokovic was taken from that old accommodation to his lawyers’ office in Melbourne, from where the hearing will continue.
Composed of three judges, the court holds the urgently convened hearing in a telematic session. The format of the court and the short time frame before the start of the tournament make the decision very difficult to appeal.
Djokovic’s legal team, which risks not being able to return to Australia for three years if he loses the case, began the procedure arguing that his detention was “illogical”, “irrational” and “unreasonable”.
The Serb’s lawyers already saved a first set point on January 10 when a lower-ranking judge reversed the cancellation of Djokovic’s visa and released him after days locked up in the migrant center.
But on Friday, the government of Conservative Scott Morrison, under pressure from elections in May, again ordered his deportation, alleging, among other things, that his public opposition to Covid-19 vaccines may make it difficult to manage the pandemic and lead to to “social unrest”.
Djokovic traveled to Australia with a medical exemption from the vaccination requirement granted by the tournament organizers based on a coronavirus infection in December, but the border authorities did not accept this exemption.
The controversy has overshadowed the tournament that Djokovic is aiming to win for the tenth time. At stake is also the record of 21 Grand Slams, with the Serb, Rafa Nadal and Roger Federer currently tied at 20.
