The Air Line Pilots Association (APLA) announced this Friday that they began legal actions against the regulation of the operation of foreign aircraft and crews established by the National Civil Aviation Administration (ANAC) during the same day.

Through the social network This is based on DNU 70/2023, which modifies the Argentine Aeronautical Code“, begins the writing.

”These decisions seriously affect our national aeronautical industry. If we have authorized and trained Argentine pilots, there is no reason to implement this procedure”, they assured.

Along these lines, they argued that “This measure not only puts at risk the employment of those who work hard to guarantee security in our skies, but also threatens our sovereignty.”

Later, they confirmed that they are ”taking legal action to challenge this new regulationwhich is based on a DNU that has already been declared unconstitutional by Justice.” ”At APLA, we firmly reject the decisions that do not protect the work of our professionals,” they concluded.

What does the resolution say?

The national government regulated the authorizations for commercial air operations with personnel and aircraft with foreign registration, in accordance with what was determined by the decree issued last month, by which the authorization of these procedures was left in the hands of the ANAC.

It did so through resolution 363/2024, published today in the Official Gazette, which regulates articles 106 and 107 of the Aeronautical Code (Law 17,285).

Through this regulation, the Government delegates to the ANAC the implementation of the necessary authorization procedures for foreign personnel to perform aeronautical functions in commercial aviation services, as well as the use of foreign-registered aircraft to operate in our country when an airline requires it.
