The General Inspection of Justice (IGJ) suspended the Ordinary General Assembly which was scheduled for next October 17 by the Argentine Football Association (AFA). In it, it had been ruled that Claudio Chiqui Tapia be re-elected for a second term in the position he has held since 2017.
In addition, the suspension of descents and the possibility that there will be 30 teams again First Division. Given this panorama, the future of the AFA and Argentine football is unknown.
As Ámbito learned, the AFA will appeal the decision.
What Tapia can do
The president of the AFA may decide to continue and hold the assembly anyway. But both in that case, he and the assembly members who participate in the process may have criminal charges for disobedience.
This is because the article 239 of the Penal Code sentence: “Anyone who resists or disobeys a public official in the legitimate exercise of his or her functions will be punished with imprisonment from fifteen days to one year.”
This disobedience would put Chiqui Tapia on dangerous ground, since in addition, the AFA directors could be accused under the article 301 of the mentioned code. This sanctions those who endorse acts contrary to the law.
Likewise, before taking that path, The AFA may appeal to the National Chamber of Civil Appeals, although this would slow down the whole processsince the Assembly could not be held until the dispute is resolved. Then, the re-election would not have a resolution until the case is resolved.
The resolution period could take several monthswhich would make it difficult for Tapia to ensure he continues in his position for four more years.
The claim of Talleres de Córdoba
From the Cordoba club they had indicated that “There is no reason to advance the elections a year when all directors have a current mandate; The call was made abruptly and without notice to the clubs with sufficient advance notice; “This prevented the members from being able to try to put together lists of candidates with enough time, and carry out an electoral campaign.”
Along these lines, they maintained that “in a preventive and prior to a ruling from the IGJ being issued on the matterthe AFA asked the court that the elections be held in any case beyond what the IGJ establishes and that the validity of the electoral process be discussed with the elections already consummated.”
The club that leads the now suspended Andres Fassi He sought to avoid the assembly, given the rivalry that prevails between the president of Córdoba and Claudio Tapia. Everything revolves around the defense of the SAD by Fassi, and the opposite position by Tapia.
