By decree, the government of Javier Milei limits naming state assets with their own names

The new regulations were made official through Decree 1084/2024 in the Official Gazette. In detail, it provides: “The exhibition, placement or dissemination of images, symbols, works or any other personal reference is prohibited. that can be interpreted as a form of partisan political propaganda or cult of political personality in buildings or public works, offices, monuments or other movable or immovable property belonging to the national State.”

The Government assured that the measure seeks avoid the use of public resources for personal or party self-promotion purposes.“The intended purpose is to provide greater objectivity to denominations or nomenclatures and prevent them from suffering the ups and downs inherent to changes in government, thus allowing the passage of time and the objectivity that this provides to be the one that issues a fair and balanced judgment on the decisions made by officials,” they detailed in the Decree.

In this scenario, the decree prohibits “the exhibition, placement or dissemination of images, symbols, works or any other personal reference that can be interpreted as a form of partisan political propaganda or cult of political personality in buildings or public works, offices, monuments or other movable or immovable property” belonging to the national State.

Also limited is “the naming of the assets mentioned in article 1 of this decree with names of political personalities before TEN (10) years have elapsed since his death or physical disappearance or from the historical events that are intended to be honored.” In this sense, the appointment may not refer to people who have exercised “functions as National, Provincial or Municipal Authorities through acts of force against the Constitutional Order and the Democratic System.”

In article 3, the ruling party also prohibited public officials, regardless of their rank and mode of appointment or hiring, “use resources or assets in the public or private domain of the NATIONAL STATE for the purpose of promoting, celebrating, commemorating or honoring their own image, ideology, political affiliation, political party or any personal attribute.” The measure came into effect upon its publication and was signed by President Javier Milei and Chief of Staff Guillermo Francos.

The Government modified the law on Comprehensive Protection of the Rights of Girls, Boys and Adolescents

In another Decree, 1086/2024, the Government took another step in what was dubbed the “cultural battle.” In this sense, the Milei administration modified Law 26,061 to prevent the “indoctrination” in schools: established that “the imposition of a partisan political way of thinking and/or acting, especially in the educational field, violates the right to dignity and personal integrity” of the minors.

The norm seeks to be framed in article 13 of the Convention on the Rights of the Childwhich states that the child will have right to freedom of expressionwhich includes the freedom to seek, receive and disseminate information and ideas of all kinds, regardless of borders, whether orally, in writing or in print, in artistic form or by any other means chosen by the child.

In detail, the new regulations incorporated the following text as the last paragraph of article 9 of the Regulations of Law No. 26,061 on Comprehensive Protection of the Rights of Girls, Boys and Adolescents, approved by article 1 of Decree No. 415 of April 17, 2006: “The imposition of a partisan political way of thinking and/or acting, especially in the educational field, violates the right to dignity and personal integrity of children and adolescentss, constituting treatment that affects their personal integrity.”
