DFB smashes the appeal of Kiel and St. Pauli against lighter throwing judgment
The legal processing of the lighter throw against Bochum goalkeeper Drewes has an impact on the relegation battle. Holstein Kiel and FC St. Pauli fail in the appointment.
The objection of relegation candidates FC St. Pauli and von Holstein Kiel in the appeal negotiation about the lighter throwing sign from the Bundesliga has been rejected. The appeals against the judgment were inadmissible, the Federal Court of the German Football Association in Frankfurt/Main decided.
The two clubs were not involved in the scandal game 1. FC Union Berlin – VfL Bochum on December 14th, but saw an influence on the integrity of the competition – strictly speaking on the relegation battle.
“A not practicable way”
Any club can have a legitimate interest, said the judge. It was checked when there was an “immediate” interest. The circle of the clubs could not be drawn too big. “This would be a non -practicer way,” it said as a reason.
The association’s sports court had judged first instance that the game was not rated 1: 1 as it went, but 2-0 for the Bochumer. The encounter in the stadium on the old forestry was interrupted in the 92nd minute for more than 25 minutes after the Bochum goalkeeper Patrick Drewes had been hit by a lighter thrown out of the Union block and had to get off the field.
In addition to Union Berlin, St. Pauli also had table 15. And Kiel as the bottom of the state appeal against the judgment of the sports court. At the start of the second hearing, however, the DFB Federal Court, chaired by Oskar Riedmeyer, decided that the appeals are not admitted.
Bochum’s lawyer: “They are only concerned with the points”
Bochum’s lawyer Christoph Schickhardt said in the direction of the legal representation of Kiel and St. Pauli: “Stop with morality and sporting integrity – you are only concerned with the points.” On the last matchday, St. Pauli welcomes the Bochumer – possibly for a final for the class.
If the Federal Supreme Court confirmed the judgment of the sports court on January 9, Bochum would have two more points in the table and, according to the current status, would outperform the 1. FC Heidenheim, which did not want to interfere in the legal dispute, and to displace two points. Berlin (13th) would be deducted.
