In the case of the two companies, compulsory criminal proceedings are pending due to violations of the filing obligations, as a spokesman for the Innsbruck Regional Court explained. Signa did not comment.

According to the Corporate Code, corporations, including stock corporations, are obliged to submit their annual financial statements, including the management report and the auditor’s report, to the Commercial Register Court no later than nine months after the balance sheet date. With a balance sheet date of December 31, 2021, the financial statements for the Signa companies should have already been published.

According to the court spokesman, the proceedings concern the companies and their “authorized representative bodies”. From the duration of the pendency of the compulsory criminal proceedings it can be concluded that penalties have already been imposed three times for missing the deadline. According to the law, the amounts of the penalties vary and depend on the size of the company. At Signa Prime it should be 4200 euros for the company and per authorized representative body, at Signa Development around 700 euros.
