Through the Resolution 753/2023, the Ministry of Energy in charge of Flavia Royón is modified Resolution 614/23which called for the presentation of new projects for manufacturing plants bioethanol and/or extensions of existing plants.

The original resolution established a period of 45 days runs for the presentation of the projects, but the amending resolution reduces that period to 30 calendar days. The reason for this change is “the imperative need to have the volumes of bioethanol“necessary to comply with the supply commitments established by Law 27,640.


The resolution resolves two main issues:
- Calls for the presentation of new manufacturing plant projects and/or expansions of existing plants to satisfy a minimum volume of 250,000 cubic meters per year of bioethanol. This resolution is based on Law 27,640, which establishes mandatory mixing percentages with fossil fuels. The increase in gasoline consumption means that the volumes of bioethanol currently available are insufficient to supply mixing companies.
- Modifies Article 5 of Resolution 614/23 of the Ministry of Energy, to establish that the lack of compliance with any of the requirements established by the complementary regulations will authorize the Enforcement Authority to revoke and/or reduce the quota and/or increase the quota duly granted. This modification is intended to ensure compliance with established requirements to obtain bioethanol quotas.
In detail, article 1 of the resolution resolves:
- Call for the presentation of new manufacturing plant projects and/or expansions of existing plants to satisfy a minimum volume of 250,000 cubic meters per year of bioethanol.
- Instruct the Undersecretariat of Hydrocarbons of the Ministry of Energy to dictate the pertinent complementary regulations in order to establish the guidelines and requirements to be met by the owners of those.
- Establish a period of 30 calendar days since the entry into force of the complementary regulations mentioned above, for the presentation of the projects through the entry table of the Ministry of Energy.
Article 2 of the resolution resolves:
- Modify the Article 5 of Resolution 614/23 of the Ministry of Energy, to establish that failure to comply with any of the requirements established by the complementary regulations will empower the Application Authority to revoke and/or reduce the quota and/or the expansion of quotas duly granted.
- Establish that unjustified non-compliance with the works schedule presented by the owner of the beneficiary project of the new quota and/or extension of the existing quota, obtained within the framework of this measure, will be considered a very serious offense in the terms of the provisions of Article 19 of Law No. 27,640.
