The governor of the province of Buenos Aires, Axel Kicillof, considered today that “It’s a real scandal” the possibility that the Federal Court of Criminal Cassation confirms this Wednesday the sentence imposed on Cristina de Kirchner to six years in prison for the alleged direction of public works in Santa Cruz in the so-called Roads case.
“The ruling that will be announced on Wednesday is a true legal scandal, according to what we found out from the newspapers”stated the Buenos Aires president when leading a press conference at the Government House, in La Plata, together with the Minister of Government, Carlos Bianco; of Justice, Juan Martín Mena; of Development, Andrés Larroque; and Vice Governor Verónica Magario.
It is expected that the Chamber will confirm the sentence imposed on the former president by the Federal Oral Court No. 2 on December 6, 2022 for the crime of fraud against the public administration. Fernández’s entourage has already announced that, if this happens, they will appeal that ruling before the Supreme Court of Justice, so it will not be final yet.
Therefore, even if Cassation confirms the sentence, the new head of the Justicialista Party will not go to prison, since the sentence is final and has application, once all judicial review instances have been exhausted. That is to say, when the Supreme Court rejects the accused’s last appeal, which could take years.
The governor stated that this “it inaugurates a new genre, law fiction, by which judicial opinions are issued where there is not a single piece of evidence, a single crime in the files and where the person accused, Cristina, did not have the possibility of carrying it out, she could never have done so.” committed by the administrative function that it had.”
He analyzed that “an operation was generated to generate a negative image and then it became something almost common sense” and highlighted that “when examining the sheets of the files, there is not a single piece of evidence: none of the decisions that were made were her concern. “They could have had to do with some irregularity that, to make matters worse, was not committed.”
Held: “It’s fiction, fantasy. What was going to be said on Wednesday did not happen, but it seeks to generate a discipline strategy. A fake trial and fictitious sentence to dirty, muddy. The aggravating factor is that the sentence includes the prohibition of holding public office, so it is persecution and proscription” and added that “it is very serious in historical, political and legal terms, also in terms of the future.”
Kicillof stressed that it was demonstrated in Justice that “the works were done and without markups,” he noted that “this process begins with a lack of paperwork and there are no elements not only for a conviction, but also for carrying out a trial” and concluded: “It is a path of infamy, there is not a single proof. Nothing that was judged as a crime had happened. This appears in the file.”
However, he stressed that “the sentence is already written, the newspapers announce. There are judges who played tennis or soccer with Mauricio Macri in his villa and now they appear as neutral and are going to issue a sentence” and added: “Everything is wrong, there were no overcharges, nor unfinished works. It is one more chapter in this process of political, judicial, and media persecution that we call lawfare.”
“Our absolute rejection, repudiation of what is going to happen on Wednesday. We want to denounce it, deplore it and express our absolute support and solidarity with the victim of all this, which is Cristina. From the government of the province we are going to continue working so that the Judiciary does not lend itself to these maneuvers,” he concluded.
