They eliminate key procedure for the importation of paintings, lacquers and varnishes: what is it

The Ministry of Health issued a resolution that modifies the procedures for the importation of products, establishing a new regulation on the allowed levels of lead in them.

He Ministry of Health issued A resolution this Thursday that modifies a resolution that regulates manufacturing, Marketing and destination of products such as paintings, lacas and varnisheslimiting the lead levels present in them. In this note, the main changes and provisions of the new regulations stand out:

  • Prior affidavit: It is established that, before the definitive importation for consumption, an affidavit must be submitted that certifies the absence of lead in the specified concentrations. This statement will be sufficient to release merchandise, provided other customs requirements are met.

  • Customs control: The General Directorate of Customs (ARCA) will be responsible for applying import controls of these products in accordance with the procedures established by Resolution No. 44/98. In addition, a customs risk analysis will be implemented according to General Resolution No. 2,605.

  • Ex Post inspection: The National Institute of Industrial Technology (INTI) will be in charge of verifying, in a later way, compliance with the regulations. This will include the representative samples of the products to evaluate the veracity of the affidavit and the compliance with the established requirements.

  • Exclusions: They are excluded from the prohibition established in article 1 of the resolution latex paintings, graphic inks, products for artistic, industrial uses and in specialized vehicles and equipment. These products do not require the aforementioned affidavit.

  • Mandatory labeling: Excluded products containing lead in concentrations greater than those established must be properly labeled, indicating warnings about health risks associated with lead ingestion.

  • Sanctions: Infractions to the provisions of the resolution will be sanctioned in accordance with Law No. 24,240 and Decree No. 274/19.

Finally, certain previous articles of Resolution 7/2009 and Resolution 436/09 of the Ministry of Health are repealed, adjusting the regulations to the new procedures and criteria established.

In summarythis modification seeks to simplify the process for importers, maintain health security and adapt the restrictions on market realities, especially with regard to the import and marketing of similar paintings and products.
