Consumer advocates complain against Lidl app

The digital bonus program from Lidl is a thorn in the side. That is your criticism.
The Bundesverband (VZBV) consumer center has submitted an injunction against the “Lidl Plus” app before the Stuttgart Higher Regional Court. Lidl does not sufficiently inform the users that they paid the app discount with their data, the association said in Berlin. It will therefore violate consumer rights.
The Higher Regional Court confirmed the receipt of the lawsuit. Lidl did not want to comment on ongoing legal disputes. The “food newspaper” had initially reported.
The digital bonus program is a thorn in the side of consumer advocates. Rosemarie Rodden, the legal officer of the VZBV, explained who uses the app, received exclusive app discounts. “But: These discounts are only available in exchange for personal data.” According to the consumer advocates, Lidl does not indicate sufficiently in the app before the conclusion of the usage contract, nor in the associated Lidl-Plus terms of use that consumers pay the app discount with their personal data.
Information obligation for digital bonus programs so far unclear
The association speaks of a pilot procedure – so far it has not been sufficiently clarified which information obligations exist for digital bonus programs that provide the data from consumers in return. According to the discounter, more than 100 million customers use the “Lidl Plus” app to benefit from discounts, coupons and promotions, the “food newspaper” continued.
The discounter, based at Heilbronn, has already caught in the past, for example with the advertising for exclusive app discounts. The Baden-Württemberg consumer center accused Lidl that the regular price for customers without an app was not specified. The procedure is pending before the Heilbronn district court. A negotiation date is not yet known.
