The decree that was initially promoted by the government of Alberto Fernández during Sergio Massa’s management at the head of the Ministry of Economy, was renewed by Javier Milei during the first days of his management, on December 13, 2023.

According to the current government, Argentina was going through a situation “Unpublished gravity” at that time due to “Deep macroeconomic imbalances that negatively impacted on the entire population”. Given that context, they stated that It is “imperative” to leave “without effect” to all those restrictions on the offer of goods and services, as well as any regulatory regime “that distorts market prices or avoid the spontaneous interaction of supply and demand, through the full restoration of the regime provided for in Decree No. 609/19 and its modifying and concordant standards.”

Due to the above, the Government considered it necessary to repeal Decree No. 28/23 “by the nature of the measure involved, to avoid the strong negative impact that could otherwise bring with it in the present economic scenario.” And to guarantee its effectiveness considering that “it is necessary that it be adopted and implemented immediately and not pre-ancient.”
