The Oral Criminal and Correctional Court No. 28 of the City of Buenos Aires resolved to request the Italian Hospital to preserve the body of Silvina Luna and its subsequent transfer to the Judicial Morgue, after the prosecutor Sandro Abraldes request this measure “for its subsequent autopsy and other expert examinations,” official sources reported today.
The court judge Carlos Rengel Mirat signed yesterday the letter in which he issued an official letter to the director of the Italian Hospital, where Luna was hospitalized since last June 13, so that “uses itself of arbitrating the necessary means for the adequate conservation of the body” of Luna and its “subsequent transfer to the Judicial Morgue”.
According to the decision, it must “be preserved until the intervening magistrate in a possible complaint of a crime of public action, provides for the measures he deems appropriate or until further indication by the undersigned.”
The resolution responds to the request of prosecutor Sandro Abraldes, in charge of Prosecutor No. 29 before the Criminal and Correctional Oral Courts, in which he asked Chamber III of the National Criminal Cassation Chamber to order the immediate preservation and custody of the body
The request of the prosecution after the death of Silvina Luna
The request was made within the framework of the case where the doctor Aníbal Lotocki was sentenced to four years in prison for the serious injuries suffered by Luna and three other womenas reported yesterday by the website Fiscales.gob.ar.
“This Prosecutor’s Office considers the preservation of the corpse and its custody by the Judicial Morgue to be of vital importance, with a view to an imminent autopsy of the body through the Thanatology Service of the Forensic Medical Corps of the National Justice,” the prosecutor said in the application.
In addition, it specified that as a result of the death of the model and actress there is “a ‘new situation’ in the conduct of this criminal proceeding.”
Abraldes added that “consequently, the production of the required test measure also becomes imperative, given the projection that -from the scientific field- the conclusions obtained from said autopsy and even complementary studies could have on health of the other three victims that exist in these proceedings: Gabriela Nilda Trenchi, Pamela Sosa and Stefanía Belén Xipolitaxis“.
Case 50949/2015 is labeled as “Lotocki, Aníbal Rubén for serious injuries in a real contest with fraud, serious injuries and serious injuries repeated on two occasions, crimes that actually concur with each other.”
The actress and model, who died yesterday, was admitted to the Italian Hospital in Buenos Aires, due to hypercalcemia that caused kidney failure, which would have been caused by cosmetic surgeries that Lotocki performed on her in 2011.
