Although initially the case was initiated due to alleged smuggling, the case was dismissed, as the accusers considered that there was no scheme on the part of the brother of Susana Gimenez to evade PSA controls.
For the prosecution, there is merit to investigate the alleged irregularity in the possession of the firearm for which Susana Giménez’s brother did not give the corresponding explanations.
Given this, Chamber B of the Economic Criminal Chamber revoked the decision of the first instance and from that the driver’s brother is authorized to investigate based on that firearmwhose origin will now be investigated in another jurisdiction that is competent for it.
