Former Alliance official Enrique Mathov was arrested for the repression in 2001

The arrest occurred after the Supreme Court confirmed his conviction the day before for the deaths in the 2001 repression prior to the fall of former President Fernando de la Rúa.

The judge Adriana Pallioti It resolved that “the sentence of four years and three months of imprisonment handed down in the proceedings having become final, and being enforceable, Enrique José Mathov – through his defense – is hereby summoned to appear before the Court on Thursday, September 19 of this year at 09:30 hours, in order to stand trial and make the arrest effective.”

The former official’s defense had requested house arrest on the grounds that Mathov is over 70 years old, something that the court will have to resolve.

Mathov was convicted on May 18, 2021, of three counts of negligent homicide and the injuries suffered by dozens of protesters in the Plaza de Mayo area during the repression that preceded the resignation of the late former president Fernando de la Rúa, who was acquitted in the case.

The former official was imprisoned for this case for 6 months and 25 days, from January 1, 2002 until July 26, 2002, when he was released. Therefore, according to the sentence calculation made by the court, his sentence will be completed on May 22, 2028.

Former Federal Police Chief De La Rúa ordered to return to the country to serve his sentence

Following the Supreme Court’s confirmation, the Federal Court of Appeals 6 also summoned the second convicted person, the former head of the Federal Police Ruben Santos, 78 years old, to return to the country within the next 72 hours to be detained. He is currently travelling in Spain, with judicial permission.

Santos was sentenced to three years and six months for the same crimes as Mathov. His defense also asked for house arrest.

Santos and Mathov were convicted in a 2016 oral trial by the Federal Oral Court 6. The verdict of that oral trial was appealed, reviewed by the Court of Cassation and ordered the sentences to be modified, which were reduced, and which the Court has now upheld by rejecting the appeals.

Mathov and Santos were convicted of the deaths of three of the protesters, Gaston Riva, Carlos Almiron and Diego Lamagna, and for the injuries caused by the police to another 20 during the protests in Plaza de Mayo, in the midst of the state of siege declared by the government of Fernando De La Rúa.
