A small Peruvian alcoholic beverage brand won a legal battle against TikTok

A small Peruvian company registered its alcoholic beverage brand TIKI TOKI despite the rejection of the global digital platform TikTok, after a legal battle in the market regulatory body and defender of intellectual property in Peru.

The regulator INDECOPI said in a statement that the parent company of TikTok, the Chinese company ByteDance, opposed the registration of the trademark, alleging that this could harm the prestige of the social network, of at least 1.5 billion users over 18 years of age according to data from specialized sources.

“Although both brands share phonetic similarities, there is no risk of confusion between them due to the difference between the products they represent,” the regulator said in a final decision granting registration of the Peruvian trademark.

“A well-known brand is one that is widely recognized by the public in relation to the products or services it offers,” stated INDECOPI.

“While TikTok is associated with digital services, TIKI TOKI distinguishes products in the alcoholic beverages category,” he said.

Reuters could not immediately locate legal representation in Peru for the firm ByteDance.
