Justice rejected SIGEN’s request for the UBA to present documentation on the use of funds

According to Judge Santiago Carrillo, “no element arises that allows us to affirm the existence of a certain danger that the supporting documentation required by SIGEN ‘will be lost or altered.'”

He Government received a setback in court this Monday after they rejected the precautionary measure requested by the General Audit Office of the Nation (Sigen) against the University of Buenos Aires (UBA) to expose data about internal regulations and documents on financial movements.

The Court Federal Administrative Litigation No. 3headed by the magistrate Santiago Carrilloargued that “the claims analyzed exceed the limited space of knowledge inherent to this type of process and would imply a preview of the underlying issue, an aspect that must be judged within a framework of greater debate and evidence.”

Furthermore, they stressed that “it cannot be ignored that the precautionary measure requested by SIGEN, with the scope that has been requested when defining its object, becomes inadmissible since it would lead to an advancement of the underlying issue which in turn would produce irreversible legal and material effects.“.

He also referred to different UBA publications in recent years. “Although the external control carried out by the AGN over national universities is not controversial in this litigation, It cannot be overstated that both of the UBA website (https://uba.ar/informes-agn) as well as the AGN, appear published reports for the years 2023, 2013, 2009, 2008, 2006“.

Finally, the judge closed: “In this initial analysis, of the circumstances outlined above and considering that the UBA has explained the characteristics of its document management systemit can be concluded that no element arises that allows us to affirm the existence of a danger certain that the supporting documentation required by the SIGN ‘be lost or altered‘” he concluded.

SIGEN’s request for the UBA to present documentation on the use of funds

The General Audit Office of the Nation (SIGEN) requested the Justice last month that the “University of Buenos Aires present the documentation referring to the use of public funds assigned by the National Executive Branch“. The writing was promoted by the General Trustee, Miguel Blanco, with the sponsorship of the Attorney General of the Nation’s Treasury, Rodolfo Barra.

The document presented by SIGEN specifies that the governing body of the internal control system “It is not intended to audit study plans, content, appointment of authorities, or affect academic freedom.“, nor “appoint the internal auditor of the UBA.” Thus, as detailed by the Government, the content of the demand only pointed out that the UBA will provide information on the destination of public funds and how they were executed.
