Alves could go to Brazil, after which extradition to Spain would no longer be possible, the court said. A 23-year-old woman reported to Alves that she had touched her privates on December 30 in a nightclub in Barcelona. He was therefore arrested in Barcelona on January 20 and taken into custody. Alves had initially denied any sexual contact. His lawyer later stated that the sexual acts had taken place with the woman’s consent.
Alves was accused by the judiciary of sexual aggression from the outset, which, following a reform of Spain’s sex criminal law last year, includes all interference with the right to sexual self-determination, from sexual harassment to rape. On Tuesday, the court spoke of possible rape in its reasoning. According to article 179 of the Spanish penal code, this can be punished with imprisonment between four and twelve years.
The Brazilian was under contract with FC Barcelona until 2022 and played for the Mexican club UNAM Pumas until his arrest. He also took part in the World Championships in Qatar with the “Selecao”. The right-back is currently in prison about 40 kilometers north-west of Barcelona.
