Supreme Court of Mexico decriminalizes abortion at the federal level

It considers the current prohibition of the procedure in the Penal Code unconstitutional since it violates the human rights of women and people with the capacity to gestate.

A failure of the Supreme Court of Mexico decriminalizes the abortion at the federal level and considers unconstitutional the current prohibition of the procedure in the Penal Code.

“The First Chamber ruled that the legal system that penalizes abortion in the Federal Penal Code is unconstitutional, since it violates the human rights of women and people with the capacity to gestate,” The Supreme Court published on social networks.

Abortion has already been decriminalized in 12 states of Mexico, and the most recent sentence was known days ago. The capital government of Mexico City was the first Latin American jurisdiction to authorize it in 2007. Most allow it up to 12 weeks.

More than 80% of the 130 million inhabitants of Mexico are Catholic, so the decision of the magistrates is historic. The ruling stemmed from a request by the Selected Reproduction Information Group (GIRE).

“All women and people with the capacity to gestate will be able to access abortions in federal health institutions,” GIRE celebrated in a statement.
