In the trial of a 63-year-old, the jury rejected the charge of attempted murder and found negligent bodily harm by a vote of 6:2. The professional judges then suspended the jury’s verdict due to the jury’s error.
This means that the trial must be repeated before a new jury after review by the Supreme Court (OGH). The new implementation is expected to take place in the second half of 2024. The defendant remains in custody for the time being.
“Not a really good baker”
On December 15, 2023, the man stabbed his 25-year-old ex-colleague in the chest with a folding knife in the bakery. “He was not satisfied with the way he was working. He decided to kill him,” the prosecutor said at the start of the trial. The defendant claimed self-defense during the interview. “I have been working as a baker since I was twelve,” said the man, who comes from Turkey and has had Austrian citizenship for 20 years.
He is “a good master baker,” while his younger colleague is “not a really good baker.” Nevertheless, the company where he started working in September 2023 only employed him on a part-time basis, even though he would have needed full employment with the corresponding insurance periods for his approaching retirement. That’s why he stopped working on December 7th and wanted to talk to the boss again the following week, claimed the previously innocent person.
“The victim was incredibly lucky”
The defendant was unable to explain why he knocked on the outside window of the bakery at 5:30 a.m. when he was still almost asleep and was let in by the later victim – the man believed that the 63-year-old had resumed his employment – as well as the fact that he had a folding knife with a blade length of 15 centimeters and a cleaver in his pocket. While the 25-year-old was looking at his cell phone, the defendant suddenly stabbed him in the bakery, the prosecutor said: “The victim was incredibly lucky.”
The blade did not open the chest cavity, but went into soft tissue in the space between the ribs: “The heart and lungs were not injured.” The 25-year-old was able to prevent another stab by taking the knife away from the 63-year-old. He was also able to take the cleaver away from him before he ran bleeding onto the street and was noticed by a passer-by who called the police and emergency services. The 63-year-old, who lost his glasses at the crime scene, was arrested at his apartment a short time later.
“I panicked. Feared for my life”
“I am innocent. He attacked me,” he claimed in his trial. The 25-year-old “doesn’t understand his craft.” Nevertheless, he “ratted” him out to the boss by taking photos of failed goods and claiming that he, the defendant, had manufactured them. That’s why he wanted to confront him. The 25-year-old first attacked him with a punch and then with the knife. In the course of a scuffle and an attempt to defend himself, the defendant was stabbed in the chest, the defendant said. When asked why he ran away and went to bed at home without caring for the injured man, the defendant replied: “I was panicking. I was afraid for my life.”
