The Graz Higher Regional Court announced this in a press release. After the verdict in the trial in February at the Leoben Regional Court, both the accused and the public prosecutor’s office appealed. The verdict is now legally binding, the Higher Regional Court said in response to an inquiry.
Several shots from service weapon
The man had a conversation with his superior on February 27, 2023. The conversation was about an unrecorded work accident and an outstanding sick leave certificate. A complaint of abuse of office was in the air. The now 48-year-old got his weapon and went back to the inspection commander’s office to talk to him. The man then fired several shots from his service weapon at his boss, hitting him in the upper body and twice in the head.

In the appeal hearing at the Higher Regional Court in Graz, the sentence was increased from the original 20 years imprisonment to life imprisonment. The hearing was held in absentia: the defendant did not want to attend the hearing, but in an appeal hearing there is only the right to attend, not the obligation.

“No remorse to be seen”
The panel of judges at the Higher Regional Court upheld the public prosecutor’s appeal and followed the argument that the accused showed no remorse. The verdict is final. The accused must also bear the costs of the appeal hearing.
