They are accused of gross negligent homicide after the 36-year-old’s five-year-old son fell out of the window on March 2 and was fatally injured.

According to the prosecution, the boy was alone for at least an hour in the apartment where he lived with his mother and her 39-year-old partner. The apartment is on the fourth floor of the Linzer Industriezeile. That afternoon, the adults left the apartment to go for a walk. The five-year-old was sleeping. The mother is said to have locked him in the children’s room, presumably for his safety.
The larger window in the room was locked, but the child was able to open the smaller one. The boy probably leaned too far out and lost his balance. He was found by a passerby in front of the house. The five-year-old was so badly injured that he died in hospital a short time later.
