The situation is not entirely simple, says the Chamber of Agriculture. Firstly, there is the question: is it a forest property? Because of course you are not allowed to just walk on private property, but you can go into a forest for recreation. But whether you are allowed to swim in a stream or river depends on the ownership situation. The Water Rights Act states that you are allowed to swim in public waters – but private waters can only be used for drinking. Most of the larger rivers are publicly owned.

New regulations for trees
As far as trees are concerned, there have been new regulations in place since May. Now, a victim must prove that the owner has breached his duty of care. Forest trees are exempt from this, as they continue to fall under the Forestry Act. And it states: along public paths, the landowners are liable; ash trees, for example, must be regularly inspected and their condition documented.
