They present a new protection against the pension reform in Santa Fe

The Teachers Association of Santa Fe (AMSAFE) filed an amparo action claiming the unconstitutionality of the provincial pension reform promoted by the governor Maximiliano Pullaro and approved by the local Legislature on September 12, on a day in which incidents occurred around the palace.

This Tuesday, in front of the Provincial courts, the general secretary of AMSAFE, Rodrigo Alonsoled a press conference in which he denounced that the brand new legislation “injures, threatens and restricts the rights and guarantees of all active and retired teachers in the province of Santa Fe.”

During his speech, the leader explained that “AMSAFE, representing thousands of members, presents today an Amparo Action against the Provincial Government and against the Santa Fe Retirement Fund for the purposes of justice, in this case the jurisdiction labor, declare the unconstitutionality of law 14,283, which is the new retirement law. We understand that it is a law that violates and restricts the rights of active and retired people that are established in the National Constitution and the Provincial Constitution.”

He specified, at the same time, that the protection has two parts. “One that has to do with the form, the lack of debate and that the voice of the workers was not heard. And a second that is about the substance and has to do with the different articles that are harming rights,” he commented.

Along these lines, Alonso stated that “we are seeing it today with the discounts, both for active and retired people.” “It must be said that we had an increase of 2.45% compared to the month of June, but what this retirement discount means is that the increase has practically not been seen in salaries and assets,” he added.

And he expanded: “We are objecting to the calculation of assets, a calculation with which they now take more from you than they give you. Therefore, it is clear that we are not going to reach 82%. Passive employees will be paid 60 days after active employees, therefore, salary increases for passive colleagues will be delayed. The optional teaching regime is also modified, this discretion that the Executive Branch has to be able to harmonize retirement ages.”

At the same time, Alonso clarified that in this action “there is no mention of the form, but rather the real discussion has to do with the fact that it was an express procedure and that is what is worrying.”

“A government that talks so much about dialogue, consensus and in the Senate, Parliamentary Labor met on a Thursday for an hour and then voted in the Chamber with an express procedure. The same in deputies, therefore, AMSAFE does objection on the substance of the law because what it does is harm the rights of both active and retired workers,” the union member launched.

“It is a law of adjustment”

On the other hand, the general secretary of AMSAFE said that “it is a law that is an adjustment law” and that “Officials and legislators will have to take responsibility for the fact that it is an adjustment law because what they do is say that we are lying.”

Regarding a possible call for a joint meeting, the teacher stated: “We had already rejected the last salary increase because we said it was insufficient and it is clear, the August increase was 3% with an inflation that was 4%. What we are going to ask for in the joint meeting is something simple, that the government for the first time comply with its electoral contract, comply with what it said in the elections.”

“We want a trigger clause, we want them to pay the 2023 debt, we want our salaries to be able to match inflation; this is what we are going to propose at the joint level. For our part, we hope that the Amparo action can prosper and that this retirement reform is not applied”, he pointed out.

In this sense, it is worth clarifying that education workers feel strongly and are convinced that rights are defended, and we are going to defend them in school, in the joint meeting and in the street. And now we are also going to defend him in court.
