The Federal Chamber of Criminal Cassation issued Agreements to integrate Colleges of Judges for the implementation of the federal Accusatory System in the General Roca federal district (Provinces of Rio Negro and Neuquén).

In order to ensure the minimum conditions for the operation of the accusatory system on the occasion of the imminent implementation of the Federal Criminal Procedure Code on November 4 in the jurisdiction of General Roca, the plenary session of the Federal Chamber of Criminal Cassation composed of Mariano Borinsky (president) Daniel A. Petrone (1st vice president), Diego Barroetaveña (2nd vice president), Angela Ester Ledesma, Carlos A. Mahiques, Gustavo M. Hornos, Guillermo J. Yacobucci, Alejando W. Slokar and Javier Carbajo dictated the Agreed on 8/2024 and 9/2024.

For them, he organized the jurisdictional bodies of the General Roca federal district – provinces of Río Negro and Neuquén – by colleges of judges in accordance with the provisions of article 36 of Law 27,146, just as he had done with the federal districts of Rosario. and Mendoza (article 15 of Law 27,146).

The colleges are groups of judges that are governed by the principles of flexibility and rotation of their members, which provides special efficiency and speed to the system. It is a different way of working that does not leave empty or vacant spaces and allows any judge from the college to intervene in the hearings that arise.

The Chamber formed three colleges, one of Review constituted by the members of the Federal Court of Appeals of General Roca, another of Trial formed by the judges of the Federal Trial Courts of General Roca and Neuquén and a third college of Guarantees Judges composed of the heads of the Federal Courts of the district.

The Federal Chamber of Criminal Cassation not only established the colleges, but another resolution of the plenary session – Agreed 9/24 – noting the existing vacancies in the jurisdiction and the low number of judges to hear in the different stages of the process, established that In the contingency described, the College of Review Judges and the College of Guarantees Judges – both from the General Roca district – are also made up of magistrates from the Federal Trial Courts of the district. This, according to the needs that arise, the flow of income and the equitable, objective and reasonable distribution carried out by the Judicial Office.

The scenario described imposed a contingency measure, to safeguard the normal functioning of the jurisdictional bodies and the proper functioning of the new accusatory prosecution regime that will soon be in force in the federal jurisdiction in the provinces of Rio Negro and Neuquén.
