According to judicial sources, Kueider appealed the judge’s resolution in federal administrative litigation, Enrique Lavié Pico, who had already validated the session where he was expelled and rejected him “in limine” a protection from the former senator to return to public office.
From this moment on, this proposal was sent to the Federal Administrative Litigation Chamber, which must define Kueider’s request to be reinstated in his position in the Senate. However, the antecedents are not favorable.
Judge Lavié Pico already endorsed the participation of Victoria Villarruel as head of the Senate – the same day as the president Javier Milei traveled to Italy– so Kueider’s claim, who had objected that the head of the Upper House should be in charge of the Executive Branch at the time of the debate, was void. “The claim formulated by the plaintiff, would imply the unacceptable declaration of nullity for the sake of nullity itself“, justified the magistrate.
In detail, about what happened during the Senate session –after which Kueider was finally removed from his bench-, Lavié Pico stated that “ there are no doubts“that Villarruel’s role “has not had any interference in the voting result to which the National Senators finally arrived in use of their exclusive powers, as they have been strictly limited in the parliamentary order to presiding over the session in question.”
In this way, the magistrate refused to give rise to the proposal made by the former senator, since it would mean declaring “nullity for nullity itself“.
Judge Arroyo Salgado denied the exemption from prison if he is brought from Paraguay
But this is not the only judicial front that Kueider faces. Hours ago, the federal judge of San Isidro, Sandra Arroyo Salgado, refused to exempt him from prison in the case that investigates him for illicit enrichment for alleged payment of bribes by the private security company Securitas, to award contracts with the state energy company of his province, ENERSA.
The judge did not accept the proposal of Kueider’s defense to guarantee his freedom if he is extradited to Argentina from Paraguay with his secretary Iara Costawith whom he is serving house arrest. Arroyo Salgado is the judge investigating the alleged illicit enrichment, failure to comply with the duties of a public official and money laundering.
New raids in the Kueider case: this time in Concordia
National Gendarmerie reviewed four properties in Entre Ríos within the framework of the case led by Arroyo Salgado. The first of the raids was last Saturday in Kueider’s private house, where he lived with Liliana Di Lellohis second wife, and his two minor children. It is the second time that it has been reviewed by security forces.
Another of the places raided by the Gendarmerie was a recovery clinic which would belong to Di Lello. The relationship with his ex-wife would have ended a little over a year ago. She is kinesiologist. The medical institution is located in Güemes, between 25 de Mayo and Sarmiento, a few blocks from the local pedestrian street.
The other places reviewed were a house and an office rented by a person who is not charged in the case. Both properties are located in downtown Concordia.
The operation took place after Kueider’s former office in the national Senate will be raidedclosed by Vice President Villarruel after the expulsion of the Entre Ríos from the Upper House.
