The magistrate stated in his resolution that the victim crossed on foot when the traffic light did not allow him to do so and that “he did not pay due attention to the cars that were circulating.”

Likewise, he stressed that the vehicles had to avoid him so as not to run over him, in addition that “His silhouette interrupted the drivers’ view” and cocaine and alcohol were found in the victim’s body, which would explain the “erratic and staggering gait” described by a witness and a traffic agent who carried out the road assessment.

For his part, Novillo Astrada’s defense lawyer, Rafael Cúneo Libarona, stated: “All the evidence we presented demonstrated that Cruz Novillo Astrada did not cross the red light and that he did not violate the duty of care of the traffic rules and that he never abandoned the alleged victim.”

In line with that, the lawyer added: ““My assistant was completely lucid at the time of the accident,” since the results of the alcohol and toxicological tests were negative.

At the time of being questioned, Novillo Astrada stated that “he was scared“, remained “surprised” and he went to his mother’s house.

“I was coming down 9 de Julio Avenue and I stopped at the red light on Arenales Street and when it turned green I moved forward. At the last traffic light, at Arroyo Street, I came with a group of cars: in front of me, a taxi, and on the left side, along Arroyo, suddenly a pedestrian approaches who I never saw, walking on the street, not on the pedestrian path”he explained.

And he expanded: “This person never stopped to look to see who was coming, so he continued walking with the green light for vehicles and it was at that moment that when he suddenly appeared, he hit him with the vehicle, so I was shocked, “I didn’t know what to do, since it was a highway, and when I hit it in the left lane, which is the fastest, I couldn’t cross to the right side.”
