According to the detail of the measure, this system will be mandatory for the significant companies of the 2016 suspension agreement and its modifications, who must anticipate the information of their exports.
The General Directorate of Customss will authorize only signatory companies to declare export destinations. The Undersecretariat of Agrifood Markets will bring a monthly registration of operations and may send information to the US Department of Commerce to verify compliance with the agreement.
In this way, the initial list of signatories is approved, subject to administrative modifications. The measure enters into force as of Friday, February 7.
The detail of the measure
The monitoring will cover 100% of the annual exports of lemon juice concentrated to the United States, included in the following tariff positions:
- 2009.39.00.110: Clarified frozen concentrated juice.
- 2009.39.00.190: Other concentrated lemon juices.
- 2009.31.00,000: Other unconcentrated sour juices.
The monitoring system will be applicable exclusively to exporting companies that the Suspension agreement 2016 and its modifications.
Those companies that, at the time of the entry into force of this measure, have signed the latest version of the agreement and submitted the corresponding documentation before the United States Department of America will be considered significant. Companies that subsequently adhere to the agreement will be considered significant and must comply with the same rights and obligations as the original signatory.
The International Dispute Resolution Directorate of the Ministry of Foreign Affairs, International and Cult trade will facilitate the application authority for a copy of the Suspension agreement and their updates, in order to determine the signatories and the reference prices agreed.
The Undersecretariat of Agrifood Markets and International Insertion, of the Ministry of Agriculture, Livestock and Fisheries of the Ministry of Economy, It will keep an updated monthly record of all exports made by the signatories. This registration will include:
- Exporter name.
- Declared reference price.
- Country of destination.
- Type of operation (final consumption or consignment).
- Argentina’s exit port.
- Loading date.
- Exported volume.
This information may be sent to the United States Department of Commerce to guarantee compliance with the Suspension agreement.
