The Corredores Viales firm must act immediately in the section between the city of Metán and the town of Yatasto. “It is incredibly broken, in some sectors you can’t even circulate anymore,” said Mayor Issa.

The Court of Justice of Salta ordered the company Corredores Viales SA to repair national route 9/34 in the section between the city of Metán and the town of Yatastobetween kilometers 1446 and 1460, within a period of 60 days. Since December 2023, the road has not been maintained due to the cut in national funds implemented by the president’s government. Javier Mileiwhich generates multiple inconveniences because it is a route with a large presence of cargo transport and long-distance buses.

Strictly speaking, the highest court of justice in Salta confirmed the judge’s precautionary measure. Sebastian Fuchoof Chamber II of the Metán Trial Court, which had ordered the immediate repair of the route. His decision arose from a lawsuit initiated by the mayor José María Issa and the councilors. In his ruling, to which he had access Scopethe magistrates determined that although the provincial courts do not have jurisdiction in this type of matter, given that the action was brought against a national entity and requires the consideration of federal norms and instruments, The Court has the power to issue precautionary measures for these cases, “in accordance with the provisions of article 196 of the Civil and Commercial Procedure Code, jurisprudence and related doctrines”.

The Court emphasized “the imperative need to act in this specific case, emphasizing the safeguarding of fundamental constitutional rights, such as the right to life, health and bodily integrity.” And he highlighted that the implementation of a provisional solution could protect these rights without violating the right of defense and access to a natural judge. Furthermore, he highlighted that “an early intervention in this matter could have a positive impact, contributing to the prevention of damage and the fulfillment of public interest objectives.”

Out of the total of nine members of the high court, the judges voted for this measure Guillermo Catalano, José Chibán, María Alejandra Gauffin, Teresa Ovejero Cornejo, María Edit Nallim, Sergio Vittar and Adriana Rodríguez Faraldo. His peers did so in dissent Pablo López Viñals and Ernesto Samson.

long road

In April, Judge Fucho had already ordered the preventive seizure of funds belonging to Corredores Viales SA for a total of $2,000,000, as capital, plus $800,000 to cover legal accessories. The decision was also in response to the judicial claim of Mayor Issa. On that occasion, the judicial resolution also established the imposition of a daily fine of $2,500,000 for not complying with a previous order, from February. Since then, Corredores Viales did not take any action while awaiting a response and appealed. As time went by, the route deteriorated much more, which deepened the anger of the residents of the area.

During this year, four judicial protections and appeals were presented to the federal justice system due to the problem of Route 9/34. And despite this, the company did not advance with the works agreed in the contracts. Deep undulations, large potholes, deterioration of shoulders and lack of marking paint on the road are the permanent complaints. This scenario becomes highly dangerous, municipal authorities warned, during rainy periods.

“Incredibly broken”

A few days ago, Mayor Issa toured the area and then maintained contact with the media, to whom he pointed out that “the route is incredibly broken, in some sectors it can no longer even be circulated. The province tried to fix it but then they decided stop everything until the tender for the road corridors, still without a date.” He also reported that he met with Federico Casas, Director of National Roads, with whom it was agreed that a public hearing will be held in Metán on January 8, 2025 to present the Metán-Rosario de la Frontera highway project.

This Wednesday the 4th, at the intersection of National Route 34 and Pueyrredón Street, with the support of councilors, a group of neighbors will gather to protest and ask that urgent work be done on improving the road. The demonstration will take place in the morning. “The situation on the road has worsened, there are potholes half a meter by 30 centimeters deep, which caused multiple damages to the vehicles. In one day there were six tire bursts. People are left nervous, some even cry out of desperation because of the impact. There are craters on the route that are a shame,” said the official councilor. Federico Delgado.
