Smoking weed has been legal for adults since April 1st, with many restrictions. The first improvements have now been approved, which will place tighter limits on the production of cannabis on a large scale.
Stricter rules are coming for the cultivation of cannabis in clubs, which will be permitted in the future. The Federal Council passed amendments to the recently introduced legalization law, which the federal government had promised the states. They are aimed at ensuring that the cultivation clubs that will be possible from July 1st do not become large plantations. Among other things, permits can be refused if the cultivation areas are in a “structural association” or in the immediate vicinity of those of other clubs. In addition, the states can be more flexible in handling inspections of clubs – instead of “annually”, they are to be carried out “regularly”.
The law passed by the Bundestag also stipulates that a planned first evaluation of the consequences of the legalization of cannabis should examine not only the protection of children and young people, but also the quantities of cannabis that are now permitted to be owned. In general, smoking weed and private cannabis cultivation have been legal for adults since April 1st, with numerous requirements.
Cannabis rules for drivers, which were also passed by the Bundestag, are expected to be finally passed by the Bundesrat on July 5. In future, a limit of 3.5 nanograms per milliliter of blood will apply for the intoxicating substance THC while driving – similar to the 0.5 per mille limit for alcohol. Stricter rules will apply to novice drivers and those who consume both cannabis and alcohol. The new limit, including fines for violations, is expected to come into force in the summer.
