One of the ongoing criminal proceedings against Donald Trump is set to end. But special investigator Smith plans to appeal the decision in the document scandal.

While the nation was still angrily discussing the assassination attempt on its former president, Judge Aileen Cannon made a decision that left the Democratic camp speechless but Donald Trump’s team happy: The federal judge in Florida is dropping the case against Trump in the document scandal. But that doesn’t mean the matter is off the table: Special investigator Jack Smith has now appealed the decision.

Special investigator appointment “unconstitutional”

Judge Cannon – once nominated for her post by Trump himself – justified her decision by saying that US Attorney General Merrick Garland had violated the Constitution by appointing special investigator Smith to investigate the case. In doing so, she granted a request from Trump’s lawyers. She thus gave the presidential candidate a major success just in time for the start of the party convention.

The special counsel’s spokesman said that Aileen Cannon’s decision deviates from the opinion of all previous courts that have considered the issue. All of these courts have concluded that the Attorney General “has the legal authority to appoint a special counsel.”

In her 93-page statement, Cannon argued that the Attorney General’s appointment of the special investigator violated the rights of the US Congress to appoint senior members of the judiciary. Cannon did not address the content of the criminal charges against Trump in the document scandal.

Trump wrote on his online network Truth Social about the judge’s decision: “The dismissal of this unlawful indictment should only be the first step.” The “cessation of all witch hunts” should now “quickly follow.” The former president was charged with 40 counts in the document scandal and faced a long prison sentence.

Special Counsel Smith not only initiated the criminal charges against Trump in the document scandal. He also secured the indictment against Trump in a federal court in Washington for his massive attempts to manipulate the election after his defeat to current President Joe Biden in 2020.

Critics had previously repeatedly accused the judge of dragging out the case.
