The SPD, Green and FDP factions have agreed with the Union on a reform to better protect the Federal Constitutional Court from extremists. Details of their joint draft are to be presented this Tuesday in Berlin. The Federal Press Conference Association invited people to a press conference on Monday entitled “Strengthening the Resilience of the Federal Constitutional Court”, which will be attended by Federal Justice Minister Marco Buschmann (FDP), among others.
Last year, out of concern about the rise of extreme parties, the traffic light coalition proposed that regulations on the election and term of office of constitutional judges should be laid down not just in a simple law, but in the Basic Law. A two-thirds majority is required in the Bundestag for such a change, which means that the coalition is dependent on the support of the Union faction. According to information from the German Press Agency, the questions of the resilience of the Federal Constitutional Court were also discussed during the deliberations with a view to experiences in Poland.
In Poland, the now-defeated national conservative PiS government, which led the country from 2015 to 2023, began to restructure the judiciary according to its ideas immediately after taking office. The first step was the Constitutional Court. The PiS government did not recognize three constitutional judges appointed before it came to power and filled the posts with its own candidates.
