The Justice allowed the body of Diego Maradona be transferred from the Bella Vista cemetery to Memorial of Tena mausoleum located in the Buenos Aires neighborhood of Puerto Madero.
The Criminal Court No. 3 of San Isidro, which will try the doctor Leopoldo Luque, the psychiatrist Agustina Cosachov, the psychologist Carlos Díaz and other health professionals in March 2025 for the death of the former player, agreed to the request (which also counted with the endorsement of the prosecutors) that Dalma and Giannina Maradona presented on August 15.
Judges Maximiliano Savarino, Verónica Di Tommaso and Julieta Makintach determined that the transfer “must be carried out with compliance with the control measures required by the representatives of the Public Prosecutor’s Office, in their presentation of 2/5/24, and the date and time in which it will be carried out for the knowledge of all parties to the process”.
The magistrates had rejected the petition of the descendants of “Pelusa” in May and now they changed their mind.
The president of the court reasoned that they did not authorize the transfer due to the opposition of the defense lawyers of Luque, Cosachov and Díaz since there was little time left for the trial against the accused, which should have started today, but was postponed until next year.
In this sense, the ruling added: “Now, I consider that a favorable response should be granted to the new request of the affected individuals, since a new oral trial date was established for March 11, 2025; at the request of the defenses of Luque, Cosachov and Díaz, without opposition from any of the parties to the process”.

The jury trial against Madrid will begin this Wednesday in the Criminal Oral Court No. 7 (TOC) of San Isidro at 10, led by Judge María Coello (the same judge who is investigating the patricide of Vicente López) and it is estimated that It will end between November and December, as long as the parties do not raise any objections.
