Province of Buenos Aires extended the validity of promotional regimes

The province of Buenos Aires, through successive extensions, maintains a series of promotional benefits for certain localities in the jurisdiction, which came into effect in 1999.

The respective regimes demarcating the benefited areas are legislated in Laws 12,322 and 12,323, which have just been extended again in their validity through the sanction of Law 15,497 (BOPBA 7/10/24).

The new extension governs the term of five years for both laws, starting from the expiration of Laws 15,176 and 15,177, regulations that provided for the last extensions.

These are regional promotion regimes, which judging by how they are maintained over the years independently of the governments in power, seem essential to maintain population settlement and the development of industry and commerce in the parties and delimited areas. .

Consequently, and considering the new extension of validity, it is worth remembering which areas are included and the possible benefits to be enjoyed.

Law 12,322

This provincial law declares the Patagones Party, Buenos Aires Patagonian Area and promotes its inclusion as a member of Patagonia, which was finally achieved through Law 25,955, in 2004.

Regarding the benefits that reach the party, the following are provided for the productive activities of the agricultural sector, commerce and industry, without prejudice to those established by other regulations, which will remain in full force:

  • Exemption from payment of urban and rural real estate tax.
  • Exemption from paying tax on gross income.
  • Exemption from payment of stamp tax.

As can be seen, these are benefits compatible with other preferential treatments that may exist and be applied.

The stipulation of the period to enjoy the benefits is in the hands of the Buenos Aires Executive, but may not be less than ten fiscal periods, according to the law.

Law 12,323

For its part, Law 12,323 created the Southern Unfavorable Zone of the Province of Buenos Aires, currently made up of these two zones:

  • Zone A: The barracks located in the Puán and Tornquist districts not included in Zone B.
  • Zone B. The district of Villarino, barracks V, VI, VII, VIII, IX, X, XI of the district of Puán, barracks VIII, IX, Tornquist Party.

For such zones, the following promotional benefits are established for the productive activities of the agricultural sector, commerce, industry and services, without prejudice to what is established by other regulations, which will remain in full force, that is, they also have an additional nature.

  • Zone A: 50% exemption from payment of urban and rural real estate tax; of gross receipts tax and payment of stamp duty.
  • Zone B: exemption from payment of urban and rural real estate tax; of the gross receipts tax; stamp tax and motor vehicle tax for means of transport.

When productive activities are developed in the irrigable area of ​​CORFO Río Colorado, the established benefits will be limited to 50% percent of the amounts corresponding to the taxes referred to.

The Development Corporation of the Buenos Aires Valley of the Colorado River (CORFO Río Colorado) was created by Provincial Law 6245, and serves as administrator of the irrigation service of the Colorado River in the districts of Villarino and Patagones in the province of Buenos Aires.

In short, these are regimes that, despite their modifications, have remained in place for a quarter of a century and have just been extended for another five years.
