The Federal Justice ruled in favor of Banco Nación against rate increases in a municipality

The questioned ordinance imposed on Banco Nación a rate of 7.5% on a tax base that exceeds the financial activity that the entity has in the City.

The Federal Court of La Plata No. 4, headed by Dr. Osvaldo Racondo, gave rise to the precautionary measure requested by Banco Nación to suspend the increase in the Safety and Hygiene Rate“whose unreasonableness and disproportion would cause irreparable damage to the Bank.”

Last September, Banco Nación had filed an action against the Municipality of La Plata in order to declare the unconstitutionality of articles 152 and 153 of the Fiscal Ordinance for Fiscal Year 2024 and article 10 of the Tax Ordinance for Fiscal Year 2024 sanctioned by the local Deliberative Council.

The questioned ordinance imposed on Banco Nación a rate of 7.5% on a tax base that exceeds the financial activity that the entity has in the City.

From Banco Nación they stressed that the entity “paid more than $5.5 billion during the first half of 2024, an amount that is equivalent to the salaries it pays in the City. With the precautionary measure obtained, said amount will decrease substantially.”

It should be noted that Banco Nación has been obtaining similar precautionary measures in different jurisdictions of the country.

Local taxes are a tax on creditsincluding on home mortgages and in some jurisdictions they prevent activity and put our presence at risk. It is progress that Justice gives rise to our proposals,” highlighted the president of Banco Nación, Daniel Tillard.

This ruling is framed in the judicial setbacks that the different municipalities accumulate and that show the unconstitutionality of local administrations to apply aliquots on various taxes.
