The Federal Court of San Carlos de Bariloche, in charge of the judge Gustavo Villanueva, granted the precautionary measure requested by the Nation Bank to suspend the increase in Safety and Hygiene Rate provided for in Tax Ordinance No. 2374, under the argument that “the amount demanded is exorbitant, disproportionate and confiscatory”.

In the grounds of the ruling, it is noted that the rate “It lacks a legitimate cause since it does not correspond to an effective, concrete and individualized provision of services by the Municipality to the Bariloche branch.”
Furthermore, it is established that the regulations are “manifestly unconstitutional” and warns about “the danger in delay, given the economic damage and potentially irreparable that would imply continuing to pay a rate that it considers disproportionate and confiscatory, which could even affect the continuity of its branch in the city.”
Finally, the ruling orders the Municipality of San Carlos de Bariloche to immediately refrain from applying to Nation Bank the aforementioned rate and that “to carry out acts aimed at its collection, tax execution or application of accessories or fines for such concept.”
In this regard, the president of Banco Nación, Daniel Tillard He insisted that “municipal rates hinder the granting of loans to the SMEs and to Argentine families. We have the mandate of President Javier Milei to boost credits and every day we work so that the promise of zero inflation is accompanied by a proposal for abundant credit.”
