In order to strengthen the transparency of the financial system and prevent fraudulent maneuvers, the Customs Collection and Control Agency (Ark) and the Central Bank of the Argentine Republic (BCRA) implemented a new regulation that prohibits the use of credit and debit cards to Taxpayers considered “Non -reliable”.

Punctually, the Communication “A” 8144 of the BCRA, it establishes that the financial entities and suppliers of payment services are prohibited from accepting payments with Debit cards, credit, purchase or prepaid of those users who have been identified as “non -reliable taxpayers.” And covers both new applicants and those who already possessed these means of payment.


They are usually included in this base Taxpayers that present inconsistencies between their operational, economic and/or financial capacity, and the information that they externalize in their affidavits, or that do not document it correctly.

But there is a thin line between duties and rightsand this measure makes me doubt whether the State has the right to prevent commercially operating companies that have committed some infraction.
It seems an extreme decision that an official of an administrative agency can prevent a company from operating commercially being able to take it to an economic and irreversible crisis.
Not only do we think that the State should not impose sanctions that prevent free trade, but in any case these types of decisions should be resolved in the judicial field, not in the administrative field where arbitrariness usually prevails.
Moreover, before discussing whether the paternalistic state can choose who can and who not develop an economic activity, should solve their own problems of suitability and integrity of many of its officials and, perhaps, there could begin to discuss what legitimacy has to impose extreme sanctions.
An arbitrary decision could have catastrophic economic consequences for a company or an individual, therefore they should be measures that are applied rationally and after a deep investigation. Hopefully these restrictions are applied with these criteria and not that they are a result of debatable impulses.
